Months after his brother was found not guilty, the second man charged in a fatal shooting that started with a dispute over public urination has now cast his fate with a jury.

Malik Garner, 23, is charged with first-degree intentional homicide of Deirera McGhee in the fall of 2013, as well as first-degree recklessly endangering safety in another shooting a month earlier.

According to the criminal complaint and opening statements in the case:

About 6 p.m. on Oct. 17, 2013, police responded to a "subject with gun" complaint at a residence in the 4600 block of N. Teutonia Ave. When police arrived, Diean Pittman told them a man, part of a group of four, was urinating at the side of a building she owned, according to a criminal complaint in March 2014.
