First-degree murder charges have been filed against a man accused of fatally shooting another man inside a gym at a high-rise apartment building on the Near West Side.

Reggie Daniel, 48, surrendered to police about eight hours after Darrin Joss, 45, was shot dead while working out on an elliptical machine in the gym on the eighth floor of a high-rise on the 500 block of West Kinzie Street about 7:05 p.m. Wednesday, according to police.

Police said Daniel, who uses a wheelchair, shot Joss in the head and chest after getting into an argument.  Both of them lived in the building, Joss on the 35th floor and Daniel on the 15th floor.

"I heard one shot, then I turned and I saw (the victim) fall," said a resident, who asked not to be named.  "He was on the (elliptical) machine. After, he rolled right past me. I didn’t know what to do. I mean, dude had a gun."

Joss was bleeding from the head and was struggling to breathe as a staff member hid under a desk and residents scrambled to hide, according to the resident.
